Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Kyrsten Horvath, doing business as Bellynote ("Bellynote," "we," "us," or "our"), and govern your access to and use of the Bellynote mobile app and the bellynote.app website (together, the "Service").

By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you don't agree, don't use the Service.

Not medical advice. Bellynote is a self-tracking and pattern-recognition tool, not a medical device and not a substitute for professional medical, nutritional, or dietary advice, diagnosis, or treatment. See Section 5 below before relying on anything the app tells you.

1. Description of Service

Bellynote lets you log meals, symptoms, and activities: manually, by taking or uploading photos, by scanning barcodes or ingredient labels, or by importing entries from connected third-party apps. It uses AI to help identify foods, extract ingredient information, and surface potential correlations between what you eat and how you feel. Bellynote may add, change, or remove features at any time.

2. Eligibility & Accounts

You must be at least 17 years old to use Bellynote.
You must provide accurate information when creating your account and keep it up to date.
You're responsible for keeping your login credentials confidential and for all activity that happens under your account.
Notify us promptly at support@bellynote.app if you suspect unauthorized use of your account.
Accounts are for individual, personal use. You may not create an account on behalf of, or share access with, someone else.

3. Your Content

"User Content" means the logs, notes, photos, tags, and chat messages you submit to Bellynote. You retain ownership of your User Content. By submitting it, you grant Bellynote a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and process it solely as necessary to operate and provide the Service to you, including transmitting meal/label photos and chat messages to our AI service provider to generate the analysis and responses you request (see our Privacy Policy). We do not use your User Content to train third-party AI models, and we do not sell it.

You're solely responsible for the User Content you submit. Don't upload anything you don't have the right to share, or that is unlawful, infringing, or violates someone else's privacy.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms;
Reverse-engineer, decompile, or attempt to extract the source code of the app, except where applicable law permits it;
Scrape, crawl, or use automated means to access the Service outside of normal app usage;
Interfere with or disrupt the integrity or performance of the Service;
Attempt to gain unauthorized access to other users' accounts or data;
Impersonate any person or entity, or misrepresent your affiliation with anyone;
Upload malicious code or content that infringes anyone's intellectual property or other rights.

We may suspend or terminate accounts that violate this section.

5. Health Disclaimer: Please Read

Bellynote, including its AI meal scanner, label analyzer, correlation/heatmap analysis, and AI chat assistant, is provided for informational and self-tracking purposes only. It is not a medical device, does not diagnose, treat, cure, or prevent any disease or condition, and is not a substitute for advice from a physician, registered dietitian, or other qualified healthcare provider. AI-generated identifications, correlations, and responses may be incomplete, inaccurate, or wrong. Always consult a qualified healthcare professional before making decisions about your diet, symptoms, or health, and seek immediate medical attention for any medical emergency. Don't rely on Bellynote for that. Your use of any information or analysis from the Service is entirely at your own risk.

6. Third-Party Integrations

Bellynote lets you optionally connect third-party services, including Apple Health, MyFitnessPal, Cronometer, and Lose It!. Your use of those services is governed by their own terms and privacy policies, not ours. We aren't responsible for the accuracy, availability, or practices of any third-party service, and we make no guarantee that an integration will always be available or will continue to be supported. By connecting an integration, you authorize Bellynote to access and import data from that service on your behalf.

7. Intellectual Property

The Service, including its design, software, graphics, logos, and the "Bellynote" name and marks, is owned by Bellynote and protected by intellectual property laws. These Terms don't grant you any rights to our trademarks, branding, or underlying software beyond what's needed to use the Service as intended.

8. Subscriptions & Purchases

Bellynote is currently offered free of charge. If we introduce paid subscriptions or in-app purchases in the future, additional pricing and billing terms will apply and will be presented to you (and, for purchases made through the Apple App Store or Google Play, will be billed and managed through that platform's payment system) before you're charged.

9. Termination

You may stop using the Service and permanently delete your account at any time from within the app's settings; see our Privacy Policy for what that does to your data. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you've violated these Terms, created risk or legal exposure for us, or if we discontinue the Service. Sections of these Terms that by their nature should survive termination (e.g. Sections 5, 7, 10–13) will survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY AI-GENERATED FOOD IDENTIFICATION, LABEL ANALYSIS, CORRELATION, OR CHAT RESPONSE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELLYNOTE AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $50. SOME JURISDICTIONS DON'T ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless Bellynote and its operator from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your User Content, or your misuse of the Service.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Tennessee, and you consent to personal jurisdiction there.

14. Changes to the Service or These Terms

We may modify these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in the app. Continuing to use the Service after a change takes effect means you accept the revised Terms. We may also change, suspend, or discontinue any part of the Service at any time.

15. App Store Terms

If you downloaded Bellynote from Apple's App Store, you also acknowledge that:

These Terms are between you and Bellynote only, not Apple, and Apple is not responsible for the Service or its content;
Apple has no obligation to provide maintenance or support for the Service;
In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service;
Apple is not responsible for addressing any claims by you or a third party relating to the Service, including product liability claims, claims that the Service fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation;
In the event of a third-party claim that the Service infringes another's intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of that claim;
You represent that you're not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you're not on any US government list of prohibited or restricted parties;
You must comply with any applicable third-party agreement terms (e.g. your wireless data service agreement) when using the Service; and
Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
